Toscaig Ltd — Outline application, Lye Green
Public response is encouraged by early Sept 2026 — see notes below on how to comment
Background

A company called Capreon Ltd indicated in 2025 that it was planning to seek outline planning permission for development of a housing estate on the northern part of the fields at Lye Green (off Lycrome Road) adjacent to Deer Park Walk on what is currently agricultural land that BNG have historically identified as being owned by Geltex Properties Ltd (a company registered in Gibraltar) but which has been farmed under an agricultural tenancy for many years by W J & M Mash Ltd.
Proposals first emerged in 2025 when Capreon organized a public exhibition in the White Hill centre in May 2025 and they then campaigned to avoid undertaking an Environmental Impact Assessment (EIA) for their proposals to build 150 homes plus all weather sports pitch. BNG understand that their application not to undertake EIS was later refused by the Council.
An outline planning application has just been submitted to Buckinghamshire Council by a company called Toscaig Ltd (Company number 12069223 – see planning application notes that follow below).
The subject land at Lye Green is reflected in Land Registry title # BM 20138, where previous searches of the register revealed that at least up to the end of last year that this land was owned by Geltex Properties Ltd (a company registered in Gibraltar). However, the shareholders of Geltex are themselves various overseas shell corporations and the ultimate beneficial owners of the subject site have always been unclear. Geltex Properties Ltd, were previously represented in the UK by Capreon Ltd, who arranged the aforementioned public exhibition in the White Hill Centre where a director of Capreon Ltd asserted that Capreon were the "landowner".
However, the subject planning application is now noted to have been submitted by Toscaig Ltd (Company number 12069223) and recent enquiries on 24 July 2026 at Land Registry reveal that there are "pending applications lodged against the Title" typically suggesting a recent change of ownership which can sometimes take several months to complete on Land Registry.
Clearly there has been a very recent reorganisation of ownership of this land which is itself confusing but it is noted that at least one of the Officers of the applicant company (Toscaig) is a Gibraltar resident and was also named as an officer of the shell companies holding shares in Geltex Properties Ltd.
Latest accounts for Toscaig Ltd (to Sept 2025) assert that the immediate parent company is Toscaig Holdings Limited, a company registered in the United Kingdom and that the ultimate controlling party is Myddleton Holdings Limited, a company registered in Gibraltar.
Myddleton Holdings Ltd (in Gibraltar), was also identified by BNG as one of the entities holding shares in the former overseas owner of the subject land, namely Geltex Properties Ltd.
BNG is aware that requirements to Register Overseas Entities came into force on 1 August 2022 through the Economic Crime (Transparency and Enforcement) Act 2022 and that the Register is held by (UK) Companies House and now requires all overseas entities that own land or property in the UK to declare their beneficial owners and/or their managing officers. Previous enquiries by BNG at UK Companies House failed to find any company listed on the Register of Overseas Entities with the name "Geltex" within their title and BNG are compelled therefore to question why has there been such secrecy about the ultimate ownership of this land and why the most recent apparent changes to ownership to give the impression ownership is UK based?
The most recent accounts for Toscaig Ltd also reveal that Nashleigh House, in Lycrome Road, Chesham, HP5 3LA was purchased on 17 October 2025 for £1,613,094. This property does NOT appear to form part of the current outline application.
Planning application — July 2026
BNG have just learnt in July of an Outline planning application submitted by Toscaig Ltd on 17 July 2026 with all matters reserved except for one means of access now for up to 170 new homes (Use Class C3), mixed-use commercial development (Use Classes E, F1, F2 and C3), together with vehicular access from Lycrome Road, play facilities, highway works, new walking and cycling routes connecting to Brushwood Junior School/Chesham. (The all-weather sports pitch and flood lighting now appears to have been dropped).

The public are invited to make comments on the proposed outline development before 4 September 2026. To make comments online you must Register & Login from the "Comments" page in the above link. Any comments must quote the Planning Ref # of PL/26/05402/OA.
If commenting online, the time available to enter comments in the Public Access area of the Council's website expires quite quickly. So to avoid losing long comments, consider typing them in a separate document first (such as Word or NotePad) and then copying and pasting them into the comments page on the Public Access area of the Council's website.

This is an outline planning application meaning that if outline consent were to be granted then some detailed aspects of the application will be decided later (these are known as "Reserved Matters").
BNG regard this application as "inappropriate development" in the Green Belt, that is contrary to Nation Planning Policy Framework (NPPF), and because it represents development at an unsustainable location that is too far from the town centre or train station that will result in the loss of good quality agricultural land, generate increased traffic & congestion for the town and will result in outward sprawl of Chesham with the hamlet of Lye Green losing its individual identity and simply becoming part of "greater Chesham". Other issues have been highlighted in BNG's response to this proposal.
BNG also feel this is a major development where there are potentially too many reserved matters and that a detailed application is more appropriate than an outline planning application.
BNG's response to this application
BNG have made the following comments in relation to Toscaig's Outline Planning Application which includes many material planning considerations that BNG supporters may wish to reflect upon or on which they might have additional knowledge with which to comment upon further when making their own responses.
BNG hope the Council will consider our submission together with any other individual submissions made by the public to conclude that this application should be refused.
